Terms of Service
Read this carefully. By creating an account, booking a ride, or driving with RideWave, you enter a binding agreement with us. These Terms include a class-action waiver and a binding arbitration clause (Section 13).
About RideWave
RideWave is a technology platform operated by RMRS LLC (Rocky Mountain Ride Share), a Colorado limited liability company holding Colorado PUC permit #06760. We connect riders looking for transportation with independent driver-partners who provide it.
RideWave is not a transportation carrier. We do not own vehicles, employ drivers, or directly provide rides. We license technology that allows independent contractors to offer transportation services to riders.
Acceptance & Eligibility
By accessing or using RideWave, you confirm that you have read, understood, and agreed to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
To use RideWave, you must:
- Be at least 18 years old (riders under 18 must be accompanied by a fare-paying adult);
- Be legally able to enter a binding contract;
- Not be barred from using the Service under U.S. or Colorado law;
- Provide accurate, current, and complete account information.
Drivers must additionally meet the requirements in our Driver Agreement.
Your Account
You are responsible for keeping your password confidential and for all activity under your account. Notify us immediately at rsrs@blackcarservice4u.com if you suspect unauthorized access.
One person, one account. You may not transfer your account, share login credentials, or operate multiple accounts to evade rules or fees.
The Service
RideWave currently offers four ride tiers — Wave Classic, Wave XL, Wave Black, and Wave Black SUV — across the Denver metro area, the Front Range, mountain corridors, and Denver International Airport (DIA).
We may add, modify, or remove features, tiers, or service areas at any time. We do not guarantee availability of any specific driver, vehicle type, or service area at any specific moment.
Rider Conduct
When using RideWave as a rider, you agree to:
- Treat drivers with courtesy and respect;
- Wear a seat belt at all times;
- Not bring open containers of alcohol, illegal drugs, weapons (except as permitted by Colorado law and disclosed in advance), hazardous materials, or live animals other than service animals;
- Not request that the driver violate traffic laws or speed limits;
- Not soil, damage, or vomit in the vehicle (cleanup fees apply — see Section 9);
- Not harass, threaten, or assault drivers or other passengers;
- Not use the Service to commit any unlawful act.
Driver Conduct
Drivers operate as independent contractors and must follow the full Driver Agreement. At minimum:
- Hold a valid Colorado driver's license and personal auto insurance meeting Colorado TNC requirements;
- Operate a vehicle in safe, clean, mechanically sound condition;
- Drive sober and undistracted (no phone use beyond hands-free navigation);
- Not discriminate against riders on the basis of race, color, religion, national origin, ancestry, sex, gender identity, sexual orientation, age, disability, or any other protected class;
- Accept service animals as required by the ADA;
- Maintain a minimum 4.5-star rating to remain active on the platform.
Payments & Pricing
Fares are estimates shown at the time of booking based on distance, time, and ride tier. The actual fare may vary based on the route taken, traffic, extra stops, waiting time, tolls, or cleanup fees.
RideWave does not collect, process, or hold rider payments. Riders pay drivers directly at the end of each ride — either in cash or by card via the driver's own payment terminal. The financial transaction is between you and the driver. RideWave is a technology platform that connects riders and drivers; we are not a party to the payment.
RideWave does not store rider card numbers, billing addresses, or any other payment information.
Cancellations
You may cancel a ride before the driver arrives. Cancellations made after a driver has been dispatched and is en route may incur a cancellation fee of up to $5, charged to the rider.
Drivers may cancel rides in limited circumstances (rider no-show, unsafe pickup location, rider violation of rules). Drivers who cancel excessively are subject to suspension.
Damage & Cleanup Fees
If a rider damages a driver's vehicle or causes the vehicle to require professional cleaning (vomit, spills, broken interior, etc.), the rider is responsible for the actual cost of cleaning or repair, payable directly to the driver. Reasonable amounts include:
- Minor cleanup (light spills, food debris): up to $25
- Major cleanup (vomit, blood, bodily fluids requiring professional detailing): up to $150
- Damage (broken interior, ripped upholstery, etc.): the actual cost of repair as documented by an invoice
Drivers may submit photographic evidence and invoices to RideWave at rsrs@blackcarservice4u.com. RideWave may suspend a rider's account until the matter is resolved between the parties. RideWave does not charge or collect damage fees on the driver's behalf — recovery is between the rider and the driver.
Suspension & Termination
RideWave may suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to:
- Violation of these Terms;
- Fraudulent activity;
- Threats, harassment, or assault toward drivers, riders, or staff;
- Repeated low ratings;
- Non-payment.
You may close your account at any time by contacting us. Some data may be retained as required by law (see Privacy Policy).
Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
RIDEWAVE DOES NOT GUARANTEE THE QUALITY, SUITABILITY, SAFETY, OR ABILITY OF ANY DRIVER OR RIDER. RIDEWAVE IS A TECHNOLOGY PLATFORM AND DOES NOT PROVIDE TRANSPORTATION SERVICES DIRECTLY.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, RIDEWAVE, RMRS LLC, AND THEIR OFFICERS, MEMBERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL — ARISING FROM YOUR USE OF THE SERVICE.
OUR TOTAL CUMULATIVE LIABILITY TO YOU SHALL NOT EXCEED THE GREATER OF (a) $100 or (b) THE TOTAL AMOUNT YOU PAID TO RIDEWAVE IN THE SIX (6) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
Disputes & Arbitration
These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law rules.
Mandatory arbitration. Any dispute, claim, or controversy arising out of or relating to these Terms, the Service, or your relationship with RideWave shall be resolved by final, binding arbitration administered by JAMS in Denver, Colorado, under its applicable rules. The arbitrator's decision is final and enforceable in any court of competent jurisdiction.
Class-action waiver. You and RideWave each waive the right to bring or participate in any class, collective, or representative action. Disputes must be resolved on an individual basis.
Opt-out. You may opt out of this arbitration agreement by sending written notice to rsrs@blackcarservice4u.com within 30 days of first accepting these Terms. Opting out will not affect any other provision.
Changes
We may update these Terms at any time. Material changes will be communicated via email or in-app notice. Continued use of the Service after the effective date of changes constitutes acceptance.
